GENERAL ORDERS
1. All prices quoted are valid for up to 30 days, unless notified differently at time of sale. However, this may change due to supplier price rises and Sale periods. 2. Lead times (ETA) quoted are an estimate only as provided by suppliers and may vary. Sometimes manufacturing and other delays occur which are beyond our control. Customers will be notified as soon as practicable of any delay changes. 3. A 10% deposit must be paid upon placement of order. Orders will not be placed with the supplier until a full deposit is paid. If deposit is delayed it may change the availability or Lead Time of the product.
4. Customers are responsible for checking their order and their choice of timber, stain, fabric, leather, glass colour and size of product, as Oliverbirch will not refund, replace, exchange or credit because of change of mind or incorrect choice
5. A five (5) day cooling off period applies to standard orders, after which deposits are non-refundable. 6. Made to Order items - If the order is cancelled after the cooling off period, the customer forfeits the 10 % deposit. No refunds can be given for items made to order. A store credit will be issued for monies paid less 10% cancelation fee. 7. Custom made (non-standard) items require a 50% deposit and are subject to a three (3) day cooling off period, after which deposits are non-refundable.
8. If the item you purchased is out of stock or discontinued, you will be given the option to cancel your order and receive full refund or to wait for stock to come in. We will always inform you of the status of the item you have ordered, and the expected date of arrival if it is out of stock.
PAYMENT OPTIONS
9. For purchases in store, we accept cash, debit card and credit card payments (VISA, Mastercard, American Express plus Card Fee).
10. For purchases on our website, Oliverbirch uses the EWAY Payment Gateway for all credit card transactions (VISA, Mastercard and Amex), therefore we have a high security protection for your credit card details. Direct debit details on invoice.
IN STORE LAYBY
11. The layby period is 8 weeks. A 20% deposit is required at time of Sale and regular payments required each fortnight. Extension to the layby term may only be granted by from the store manager. 12. If goods are not fully paid for and collected within 4 weeks of the agreed layby finalisation date, goods will be returned to stock. A 10% cancellation fee will apply and any additional monies with be applied as a store credit.
FLOORSTOCK CLEARANCE ITEMS
13. Floor stock Clearance items are purchased in the condition as displayed and are non-refundable.
SALES TERMS & CONDITIONS
14. Current Sales Discount offers applies only to NEW purchases; Orders & Layby made during the sales period. Discount cannot be applied to existing orders or laybys.
RETURNS
15. Oliverbirch will accept returns of smaller items due to change of mind within 7 days of purchase and item is in original packaging, with tags, is unused and is in resalable condition. A store credit will be issued once item received for the total amount paid for the item, this does not include shipping cost.
16. If the initial payment has been made using Afterpay or Zip Pay, we will not refund your Afterpay or Zip Pay account, you will be issued with a store credit.
17. For damaged or defective items please contact Oliverbirch immediately after receiving item via phone or email sales@oliverbirch.com.au
WARRANTRY
18. Oliverbirch will facilitate any valid warranty claims with the manufacturer on the purchase’s behalf. Due to the myriad of manufacturers Oliverbirch uses, the warranty is evaluated on a case by case scenario.
TIMBER FURNITURE
19. Australian and recycled timber ranges are made from natural feature grade timbers and veneer. Each piece of furniture may contain natural timber features such as: knots, gum vein, small splits, colour variation, fiddle back grain, borer holes, crown cut grain, squiggly worm, etc. These features are a result of the harsh environmental conditions these magnificent trees have endured in their natural habitat. For instance gum vein in a growth ring shows the tree survived a bushfire that year. Drought, flood or even insect attack all leave their mark. Variations may occur between stock viewed at Oliverbirch and orders. In the case of dispute the matter shall be referred to the supplier to determine natural feature grade or manufacturers fault. Oliverbirch will not be held liable for variations in natural feature grade as each individual piece will exhibit its own individual characteristics.
DELIVERY/COLLECTION
– Final payment and Delivery cost to be paid prior to delivery arrangement 20. All goods must be paid before delivery or pickup.
21. Delivery is available for large items (approximately 5 km radius of CBD) with nominated carrier. For delivery costs (including costs to areas outside the Bendigo CBD area) please consult an Oliverbirch team member for price on application. 22. Deliveries are conducted by approved external carriers or Oliverbirch team by arrangement. Does not include assembly of goods. All prices quoted are for standard deliveries with reasonable access. If items purchased are required to be carried up stairs or into other areas with limited access, please notify Oliverbirch and we will provide with a quote for your particular circumstances. The use of any additional equipment to assist in deliveries (e.g. scissor lifts, crane etc.) shall be the responsibility of the customer to arrange and pay for hire of. 23. Oliverbirch’s team and approved external carriers are experienced at manoeuvring furniture. However, in cases of a high possibility of injury or damage to purchased items the team may refuse to deliver the goods until alternative arrangements can be made. 24. It is the responsibility of purchaser to ensure that the items that you have purchased fit inside your building. (Hint – Allow an additional 15% to all measurements given on your quotation). If an item cannot be delivered due to incorrect measurements in your building you (the customer) will be charged a restocking fee of 20% of purchase price and freight costs both ways. 25. Oliverbirch is not responsible for any damage or delayed deliveries caused by an outsourced delivery or installation company. 26. If the customer requests split delivery of the purchase, charges will apply to second and subsequent deliveries. 27. If the customer elects to collect their order, they must provide sufficient resources to lift and manoeuvre their item/s(ie 2 people). Oliverbirch takes no responsibility for items once they leave our premises. The customer is responsible for all checking, packing and transport.
FINAL PAYMENTS/STORAGE
28. If the customer cannot take delivery of ordered item(s) when the item(s) arrive in warehouse, customers will be required to pay the balance owing within 14 days of the arrival.
29. The item(s) can then be held at Oliverbirch pending storage availability and delivery for maximum of 8 weeks. After this time, Oliverbirch cannot continue to store the item(s). Oliverbirch will organise delivery of the item(s) to a nominated storage location. Delivery and Storage costs become the responsibility of the customer. OWNERSHIP OF GOODS 30. Goods remain the property of Oliverbirch until full and final payment has been received. 31. Risk for the goods passes to the customer upon delivery.
PRIVACY POLICY
32. At Oliverbirch we comply with the Privacy Act 1988, which has set standards regarding the collection, storing and usage of personal information. We will not share your personal information with anyone, as we respect your privacy. You will receive email notifications from us regarding your online purchases, and we will use your email address to send you information regarding our sales and VIP events held throughout the year. If you would not like to receive these emails, please unsubscribe from our list or email info@oliverbirch.com.au to do so. Our system ensures your credit card and personal information is secure and not available to anyone else. We may disclose your details are required by law to government or regulatory authorities.
TERMS & CONDITIONS ALTERATIONS
33. Oliverbirch reserves the right to amend our terms and conditions when necessary. Terms and conditions in force at time of purchase will be applicable to your order. Notwithstanding any other provision of this contract Oliverbirch shall continue to be subject to any implied warranty provided by the Trade Practices Act 1974 (as amended) if and to the extent that this Act is applicable to these terms and conditions and prevents the exclusion or modification of any such warranty.

34. You agree that your access, and use of, the Oliverbirch website (www.oliverbirch.com.au) is at your own risk and is subject to these terms and applicable consumer laws. The information on this website is for information only, while we aim to provide accurate and current information at all times, sometimes errors do occur. We attempt to display the product colours and finishes as accurately as possible, however there may be some variations due to the viewing settings on your electronic device. Oliverbirch makes no warranties of any kind as to the operation of our website or the information, content, materials, or products included on this site. We cannot guarantee that the colour accurately reflects the real colour of any items. If you have any concerns relating to colour or finish, please contact our store. Oliver Birch is not liable for any products being unavailable or your inability to access the website. To the fullest extent permitted by law Oliverbirch will not be liable for any damage or loss arising out of the use of this website.
